§ 1. General provisions

  1. These Terms and Conditions set out the rules for registration, purchasing tickets and participation in the EMBA&MBA HUB Gala Dinner taking place on 2 October 2026 in Kraków, as well as the rules on payment, organisational changes, complaints, recording of images and processing of personal data.
  2. The Event is organised by Stowarzyszenie EMBA&MBA HUB (the EMBA&MBA HUB Association), registered office at ul. Szewska 27/2, 31-009 Kraków, Poland, entered in the National Court Register (KRS) under number 0001240402, NIP 6762719738, REGON 544712179, hereinafter the “Organiser”.
  3. The detailed programme, times, available ticket types or packages, price and the benefits included in a given ticket are published on the Event website, the Organiser’s website or in the sales system indicated by the Organiser. This information forms part of the offer relating to the Event.
  4. These Terms are made available before a ticket is purchased in a form that allows them to be saved and reproduced. Placing an order requires acceptance of these Terms.
  5. In the event of any discrepancy between these Terms and participation conditions individually agreed with the Client, the individually agreed conditions prevail.
  6. These Terms and the Event ticket apply solely to the programme held on 2 October 2026 and do not cover any benefits or programme on 3 October 2026, unless the Organiser expressly provides otherwise in a separate offer.

§ 2. Definitions

  1. Event — the EMBA&MBA HUB Gala Dinner held on 2 October 2026 at the Kościuszko Mound complex in Kraków.
  2. Participant — a natural person entitled to take part in the Event on the basis of a valid ticket, an invitation or an entry on the Organiser’s guest list.
  3. Client — a natural person, legal person or organisational unit that registers or purchases a ticket for themselves or for another person.
  4. Ticket — a name-bound confirmation of a specific Participant’s right to take part in the Event within the scope of the benefits assigned to a given package.
  5. Website — the dedicated Gala website, separate from the main mbahub.pl website, or the registration system indicated by the Organiser.
  6. Form — the electronic form used for name-bound registration or the purchase of a ticket.
  7. Participation categories — three categories: HUB MEMBER, PARTICIPANT and PARTNER-VIP.

§ 3. Conditions of participation

  1. Participation in the Event is possible after successful name-bound registration and, if participation is paid, after the required payment has been made, or on the basis of an invitation or an entry on the guest list.
  2. The number of places is limited. The Organiser may end sales or registration at any time once the pool of places has been exhausted or for important organisational reasons.
  3. The Organiser reserves the right to refuse an application before participation is confirmed, in particular for organisational or safety reasons or due to the limited number of places.
  4. An accompanying person may take part in the Event only after a separate, name-bound registration or on the basis of a separate invitation.
  5. These Terms do not set a general minimum age for Participants. In the case of a minor, registration and participation take place in accordance with the requirements of generally applicable law.
  6. Participants must comply with these Terms, the venue rules, safety rules and the instructions of the Organiser, Event staff, the venue administrator and the relevant services.
  7. The Organiser may refuse entry or further participation to a person who does not hold a valid right of entry, breaches these Terms, disrupts the Event, poses a threat to other people or property, or behaves in a manner contrary to the law or to accepted standards of social conduct.
  8. Participants should respect the nature and format of a business event. If the Organiser publishes a recommended dress code or other organisational rules, these serve as guidance intended to maintain the standard of the Event, unless expressly stated otherwise.
  9. In justified cases, the Organiser may verify the right of entry by checking the ticket, the registration confirmation or the data necessary to identify the Participant.

§ 4. Registration and ticket sales

  1. Registration and ticket sales take place via the Website indicated by the Organiser, unless the Organiser allows another form of application. There are three participation categories: HUB MEMBER, PARTICIPANT and PARTNER-VIP.
  2. An order is validly placed when the data required in the Form has been completed, these Terms have been accepted by ticking the mandatory checkbox reading: “I have read the Terms and Conditions of the EMBA&MBA HUB Gala Dinner 2026 and accept their provisions”, and payment has been made within the period specified in these Terms, if the ticket is paid.
  3. The Client must provide true, current and complete data. The Organiser is not liable for the consequences of errors resulting from data provided incorrectly by the Client.
  4. The price and scope of benefits available in each ticket category are stated before the order is placed. Where VAT applies to the price, the price is shown both as a net amount plus VAT and as the total gross amount payable.
  5. An invoice is issued at the Client’s request. The data required to issue the invoice is provided directly in the Form or in the manner indicated by the Organiser.
  6. Registration is name-bound. The right to participate and the Ticket may not be transferred to another person.
  7. If a Participant intends to use the car park, they should indicate this in the Form. The number of parking spaces is limited, and indicating the need for one does not guarantee a parking space.
  8. Reselling tickets as part of professional or commercial activity, in particular at a price higher than the purchase price, is not permitted.

§ 5. Payment and conclusion of the contract

  1. Payment for paid participation in the Event is made by traditional bank transfer to the bank account of Stowarzyszenie EMBA&MBA HUB indicated on the Website, in the Form or in the confirmation of the application. The Organiser does not use an online payment operator in the ticket sales process.
  2. The Client must make full payment within 3 days of placing the order, unless the Organiser specifies a later date in an individual confirmation.
  3. Failure to make full payment on time results in the cancellation of the place reservation without the need for any additional statement by the Organiser.
  4. The contract for paid participation in the Event is concluded once the Organiser has accepted the order and the full payment has been successfully credited, unless the Organiser confirms another form of settlement.
  5. The confirmation of registration or purchase, or the Ticket, may be sent electronically to the e-mail address provided by the Client.
  6. The Client bears the costs of connecting to the Internet and using means of electronic communication in accordance with their provider’s tariff.

§ 6. Right of withdrawal

  1. Where the Client is a consumer, or an entrepreneur to whom the law grants consumer rights in a given situation, the provisions of the Polish Consumer Rights Act of 30 May 2014 apply.
  2. Since the subject of the contract is participation in an event held on a specifically designated date, including in particular catering services and event-related benefits, the right to withdraw from a distance contract within 14 days is excluded to the extent provided for in Article 38(12) of the Consumer Rights Act.
  3. The above does not limit the Client’s rights under mandatory provisions of law, in particular in the event of non-performance of the contract by the Organiser.

§ 7. Programme changes, change of date, cancellation and refunds

  1. The Organiser may make justified changes to the programme, the order of items, times, hosts, panellists, partners, room layout or other organisational elements, provided that this does not fundamentally change the nature of the Event.
  2. A change to individual elements of the programme, in particular a host, panellist or the order of items, does not in itself constitute grounds for a refund of the ticket price, provided that the essential nature and scope of the benefits are maintained.
  3. If the Event is cancelled by the Organiser, the Client will receive a refund of the ticket price paid. As a rule, the refund will be made using the same method as the payment, unless the parties agree otherwise.
  4. If the Event is postponed to another date, the Organiser will announce the new date. The ticket remains valid; a Client who cannot attend on the new date may request a refund of the ticket price within the period specified in the Organiser’s announcement, which will be no shorter than 7 days from the date it is sent.
  5. If the venue is changed to another venue in Kraków of a comparable standard, the Organiser will inform Participants with appropriate notice. If the change results in a significant reduction in the scope of the service, the Client retains their statutory rights.
  6. If holding the Event becomes impossible or significantly hindered due to force majeure or decisions of public authorities, the Organiser may cancel, postpone or appropriately modify the Event. The Organiser will then announce the consequences for tickets and settlements, in compliance with applicable law.
  7. Failure to use a ticket for reasons attributable to the Participant, including late arrival or resignation, does not entitle the Client to a refund of the price, subject to cases arising from the law or an individual decision of the Organiser.
  8. In every case in which a Participant or Client is entitled to a refund of the ticket price under these Terms, the Organiser will make the refund within 7 days of the date on which the refund obligation arose or of receiving the information necessary to make it.
  9. The costs of travel, accommodation, parking and other services ordered independently by the Participant are not part of the ticket price, unless the offer expressly provides otherwise. The Partner Hotel is a separate service provider; accommodation is booked directly between the Participant and the hotel and is not part of the Gala participation contract. Information about the discount available at the Partner Hotel may be published on the Event website.

§ 8. Complaints and contact

  1. Complaints concerning registration, ticket sales or the delivery of the Event may be submitted electronically to kontakt@mbahub.pl or in writing to the Organiser’s registered office.
  2. A complaint should allow the matter to be identified and include at least the complainant’s contact details, a description of the problem and, if it concerns a purchase, data allowing the order to be identified.
  3. The Organiser will respond within the period required by law and, in matters for which no specific period is provided, without undue delay and, as a rule, no later than within 14 days.
  4. Organisational contact regarding the Event: kontakt@mbahub.pl, tel. +48 601 370 576.

§ 9. House rules, safety and liability

  1. Participants must comply with safety regulations, fire safety rules, the rules in force at the venue and the instructions of the persons responsible for safety.
  2. It is forbidden to bring dangerous objects or prohibited substances and to engage in behaviour that may pose a threat to people or property.
  3. The Organiser may refuse entry to or remove a Participant who behaves aggressively, disrupts the Event, is in a condition that prevents safe participation or fails to follow reasonable instructions regarding order. In such a case, if the cause is attributable to the Participant, the ticket price is non-refundable.
  4. If alcoholic beverages are served during the Event, they are served in accordance with the law. Alcohol will not be served to persons to whom it may not be sold or served under applicable law, or to intoxicated persons.
  5. Participants are liable for damage they cause in accordance with general principles. The Organiser is not liable for items left unattended, unless such liability arises from mandatory provisions of law.
  6. Without the Organiser’s prior consent, it is not permitted at the Event to conduct sales, canvassing or collections, carry out advertising or promotional activities, or distribute commercial materials. This does not apply to the activities of official Partners or Sponsors to the agreed extent.

§ 10. Photographs, recordings and image

  1. The Event may be documented in photographs, video and audio by the Organiser or by entities acting on its behalf for documentary, informational, reporting and promotional purposes related to the activities of EMBA&MBA HUB and the Event.
  2. The materials may include shots of the hall, stage, panels, networking, dinner and audience. The image of a person who is merely part of a larger whole, such as a gathering, landscape or public event, may be disseminated within the limits set out in Article 81(2)(2) of the Polish Act on Copyright and Related Rights.
  3. If the Organiser intends to use a Participant’s image individually, for advertising purposes or in a manner going beyond the cases permitted without separate permission, it will obtain the appropriate consent or other required legal basis.
  4. A person who, for important reasons, does not wish to be featured in materials reporting on the Event may inform the Organiser before the Event begins at kontakt@mbahub.pl or at the registration desk. The Organiser will take reasonable organisational steps to accommodate such a request, taking into account the nature of the event and general shots.
  5. Recording all or substantial parts of panels, speeches, presentations and the programme for public dissemination or commercial use requires the Organiser’s prior consent. Taking photographs for private use is permitted provided it does not disrupt the Event or infringe the rights of others.

§ 11. Personal data

  1. The controller of personal data provided in connection with registration, ticket purchase and participation in the Event is Stowarzyszenie EMBA&MBA HUB, ul. Szewska 27/2, 31-009 Kraków, Poland, e-mail: kontakt@mbahub.pl. The Association has not appointed a Data Protection Officer.
  2. The Form may collect in particular: first name, last name, e-mail address, telephone number, company or organisation, position, participation category (HUB MEMBER / PARTICIPANT / PARTNER-VIP), information about a completed or ongoing MBA/EMBA programme and the university, invoicing data and — if provided by the Participant — information on dietary preferences or allergies.
  3. Data may be processed in particular for the purpose of: concluding and performing the participation contract (Article 6(1)(b) GDPR), fulfilling legal and accounting obligations (Article 6(1)(c) GDPR), handling enquiries, complaints, security, documenting the Event and establishing, pursuing or defending claims as part of the Organiser’s legitimate interests (Article 6(1)(f) GDPR) and, where consent is required, on the basis of Article 6(1)(a) GDPR.
  4. Providing the data required in the registration process is voluntary, but may be necessary to conclude and perform the contract, issue an accounting document or provide access to the Event. Providing information on dietary preferences or allergies is voluntary and serves solely to organise the catering properly. If the information provided constitutes data concerning health, it is processed on the basis of the Participant’s explicit consent in accordance with Article 9(2)(a) GDPR.
  5. Recipients of the data may include entities providing IT, hosting, accounting, legal, technical and organisational services to the Organiser and, to the extent necessary to organise the Event, the venue administrator and entities servicing the Event. The Organiser does not use an online payment operator. Partners or Sponsors do not receive Participants’ data for their own marketing purposes without a separate legal basis.
  6. The Partner Hotel is a separate data controller with regard to accommodation bookings. Participants book directly with the hotel, and as a rule the Organiser does not transfer Participants’ data to the Partner Hotel for booking purposes.
  7. Participants receive badges showing their first name, last name and the name of their company or organisation. The Organiser does not publish or share a separate list of Gala participants with Participants.
  8. Registering for the Event and accepting these Terms does not in itself constitute consent to marketing communication after the Event. If the Organiser offers a newsletter subscription or other marketing communication, consent will be voluntary, separate from acceptance of these Terms and will not be a condition of participation in the Event.
  9. Data is stored for the period necessary to hold the Event and settle the contract, and thereafter for the period required by law or necessary to secure claims. Data processed solely on the basis of consent is processed until consent is withdrawn or the purpose of processing ceases earlier.
  10. Data may be transferred outside the European Economic Area only where this complies with the GDPR and the required safeguards have been applied. The actual scope of any transfers depends on the technical infrastructure of the website and the communication tools ultimately selected.
  11. Data subjects have — in the cases provided for by law — the right of access to their data, rectification, erasure, restriction of processing, data portability, the right to object and the right to withdraw consent without affecting the lawfulness of processing carried out before its withdrawal.
  12. Data subjects have the right to lodge a complaint with the President of the Personal Data Protection Office (UODO).
  13. A separate Privacy Policy covering the use of the website, registration, contact, payments and invoicing and — if introduced — the newsletter will be made available on the Gala website. The rules on the use of cookies will be described in a separate Cookie Policy.

§ 12. Final provisions

  1. Matters not governed by these Terms are subject to Polish law, including, as applicable, the Civil Code, the Consumer Rights Act and the GDPR.
  2. If any provision of these Terms proves invalid or ineffective, this does not affect the effectiveness of the remaining provisions, unless the law provides otherwise.
  3. The Organiser may amend these Terms before the Event for an important reason, in particular due to a change in the law, safety requirements, a change in the sales method, a change of technical operator or other significant organisational needs. An amendment does not infringe Clients’ acquired rights and may not worsen the terms of a contract already concluded without a legal basis or the Client’s consent.
  4. The current version of these Terms is published on the Website or on the Organiser’s website.
  5. All communication regarding the Event may be conducted electronically to the address provided by the Client. The Client should ensure they are able to receive messages related to the delivery of the Event.
  6. These Terms enter into force on the date of their publication.
